These Terms and Conditions govern your use of the US Paper Cup Factory website and the purchase of custom printed products. Please read them carefully before placing an order.
1. Acceptance of Terms
By placing an order or using the website at uspapercupfactory.com, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services. These terms apply to all customers, visitors, and users of the site.
2. Custom Orders & Artwork
Artwork Responsibility: You are responsible for ensuring that any artwork, logos, text, or images you provide do not infringe on the intellectual property rights of any third party. By submitting artwork, you represent and warrant that you own the rights or have obtained the necessary licenses to use it for commercial printing.
Design Proofs: We provide a digital design proof before production. Production does not begin until you have approved the proof in writing (email confirmation is accepted). Once you approve a proof, you accept full responsibility for the final design, including any spelling, color, layout, or sizing choices shown in the proof.
Color Variation: Colors on your screen may differ from printed colors due to monitor calibration differences. We print using CMYK color profiles. If exact Pantone color matching is required, please specify this before placing your order — additional charges may apply.
Minimum Order: Our minimum order quantity is 25 pieces per product per design. Orders below this threshold cannot be accepted.
3. Pricing & Payment
Pricing: All prices are listed in US Dollars and are subject to change without notice. The price in effect at the time of order placement is the price you will be charged.
Payment: Full payment is required at the time of order placement. We accept major credit cards and other payment methods displayed at checkout. All transactions are processed securely.
Taxes: Sales tax will be applied to orders shipped within California in accordance with state law. You are responsible for any applicable taxes outside of California.
Additional Fees: Rush production, special finishing, or premium materials may incur additional charges that will be clearly disclosed before confirmation.
4. Production & Shipping
Production Time: Standard production is 3–5 business days after proof approval. Rush production options may be available upon request. Production timelines are estimates and not guaranteed — delays due to material availability, equipment issues, or force majeure events are possible.
Shipping: We ship via standard carriers (UPS, FedEx, USPS). Shipping costs are calculated at checkout based on order weight and destination. Estimated delivery times are provided by the carrier and are not guaranteed by US Paper Cup Factory.
Will Call: Local pickup is available at our Huntington Beach facility at no charge. Will Call orders must be picked up within 14 days of completion. Unclaimed orders after 14 days may be subject to a storage fee.
Risk of Loss: Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for delays, loss, or damage caused by the shipping carrier. We will assist in filing carrier claims where applicable.
5. Returns, Reprints & Refunds
Because all products are custom-printed to your specifications, we do not accept returns based on a change of mind or ordering error.
Defective or Incorrect Products: If your order arrives with a manufacturing defect or does not match the approved proof, contact us within 5 business days of delivery at orders@uspapercupfactory.com with photos of the issue. We will reprint or refund the affected portion of the order at our discretion.
Shipping Damage: Document damage upon receipt and contact us within 5 business days. We will work with you and the carrier to resolve the issue.
Proof Approval Errors: We are not responsible for errors approved in the proof — including spelling mistakes, layout choices, or color selections that were visible in the proof you approved.
First Revision: The first round of design corrections is provided free of charge. Additional revision rounds beyond the first are at our discretion and may incur a fee.
6. Intellectual Property
US Paper Cup Factory retains ownership of any original designs created by our design team. Upon full payment of your order, you receive a non-exclusive license to use the finished artwork on products ordered from us. You do not acquire rights to use the artwork with other vendors without our written consent.
The US Paper Cup Factory name, logo, and all site content (excluding customer-supplied artwork) are the intellectual property of US Paper Cup Factory and may not be reproduced without permission.
7. Prohibited Content
We reserve the right to refuse any order containing artwork or content that is:
- Obscene, offensive, or sexually explicit.
- Defamatory, threatening, or harassing toward any individual or group.
- Infringing on any third-party trademark, copyright, or intellectual property right.
- In violation of any applicable law or regulation.
Refusal of an order based on prohibited content will result in a full refund of any payment received.
8. Limitation of Liability
To the maximum extent permitted by law, US Paper Cup Factory's total liability for any claim arising from an order shall not exceed the amount paid for that specific order. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or business interruption.
9. Governing Law
These Terms and Conditions are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Orange County, California.
10. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. Updated terms will be posted on this page with a revised effective date. Continued use of our services after changes constitutes acceptance of the updated terms.
